Liability Waiver & Assumption of Risk

By creating an account and accepting this waiver, you acknowledge that you have read, understood, and agree to all terms below.

1. Nature of Service

BioStack sessions are provided via a browser-based game client. The game connects to servers operated by Intactis Bio Corp. over the internet. The quality of your experience depends on factors including but not limited to your internet connection, network latency, browser performance, and our server availability.

2. Assumption of Risk

By participating in BioStack sessions, you acknowledge and accept the following risks:

Connection Quality: Online gaming is subject to latency and potential disconnections. Performance varies by your network conditions.
Service Interruption: Sessions may be interrupted by hardware failures, software crashes, power outages, or network issues.
Experimental Nature: BioStack is a proprietary application under active development. Bugs, crashes, or unexpected behavior may occur.

3. No Guarantee of Availability

Intactis Bio Corp. does not guarantee that sessions will be available every scheduled day. Hardware maintenance, software updates, or other operational needs may require session cancellation. In the event of cancellation after payment, a full refund will be issued.

4. Limitation of Liability

To the fullest extent permitted by applicable law:

Intactis Bio Corp. shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Our maximum liability for any claim arising from a session shall not exceed the amount paid for that specific session.
We are not liable for any damages resulting from your internet connection, browser, or hardware.

5. Session Security

During your session, you are granted temporary access to a restricted environment on our hardware. You agree that:

You will only interact with the BioStack game application.
Any attempt to access other files, applications, or system settings constitutes a breach of this agreement and grounds for immediate session termination without refund.
Session activity may be monitored for security purposes.

6. Health Considerations

Video games may cause discomfort in some individuals, including but not limited to eye strain, motion sickness, or photosensitive reactions. If you experience any discomfort during gameplay, stop immediately. Intactis Bio Corp. is not liable for any health-related effects from gameplay.

7. Indemnification

You agree to indemnify, defend, and hold harmless Intactis Bio Corp., its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the Platform or gaming sessions
Your violation of these terms or any applicable law
Any unauthorized actions taken during a session

8. Severability

If any provision of this waiver is found to be unenforceable, the remaining provisions shall continue in full force and effect.

9. Governing Law

This waiver is governed by the laws of the State of Delaware. You consent to the exclusive jurisdiction of the state and federal courts located in Delaware for any disputes arising from this waiver.

10. Entire Agreement

This waiver, together with the Terms of Service, Privacy Policy, and Auction Rules, constitutes the entire agreement between you and Intactis Bio Corp. regarding BioStack sessions.
